GENERAL CONDITIONS OF USE

RESPONSIBILITIES

ayay-driver is a VTC passenger transport reservation site on Cap d'Ail and throughout the French Riviera. Each reservation on ayay-driver systematically implies acceptance by our customers of these General Conditions of Use. These are automatically applied, without obligation for ayay-driver to refute possible contrary conditions. Online service reservations on our site bind our customers to all of these rules.
RESERVATION RULES:
Luggage:

For your comfort, and for safety reasons, all luggage must be placed in the trunk of the vehicle. For this reason we ask our customers to respect the maximum number of luggage which is indicated when selecting the vehicle category. In the event of non-compliance with the maximum number of bags, ayay-driver has the right to refuse any baggage that cannot be placed in the trunk of the vehicle.
food and drinks:
In order to offer each of our passengers an equivalent quality of service, in a vehicle in perfect clean and hygienic condition, the consumption of drinks or food on board our vehicles is not authorized. Exception made for consumables made available to you by your driver on board the VTC vehicle.
Animals:
Most of our private drivers accept animals on board their vehicles, provided they are in their cage or travel bag. In order to keep our vehicles in a perfect state of cleanliness and hygiene, animals must travel in the trunk of the vehicle and are considered baggage. The customer is required to specify that he is traveling with animals. He can indicate this in the “comments” section when making his reservation, otherwise the VTC driver may refuse to take care of the animals.

Waiting:

Working only by reservation, our VTC drivers must do everything to respect our customers' reservation times and therefore cannot wait indefinitely for passengers. We therefore ask our customers to please ensure that they are ready at the time for which they have booked. Departing from a station or airport, waiting for your private driver is free. No waiting fees. Departing from any place other than a train station or an airport: 10 minutes of free waiting. Between 10 and 20 minutes of waiting, a supplement of 10 euros will apply. From 20 minutes of waiting, a supplement of 10 euros will apply and the driver may cancel the service. The customer is then liable for the amount of the reservation and waiting costs.

Cancellations:

Working only by reservation, our private drivers sometimes have to block several hours of their schedule in order to be able to perform a service. They can therefore no longer accept other reservations during this blocked time slot. A cancellation several hours before the scheduled time for the service gives the driver a chance to accept another reservation to replace the one canceled. When a reservation is canceled very shortly before departure time, the VTC driver finds himself with a hole in his schedule because he did not have time to accept/find another reservation to replace the one canceled.
For these reasons, we are therefore obliged to apply fees in the event of cancellation of a reservation. Cancellation following a canceled train or flight, no fees. Cancellation at least 12 hours before reservation time, no charge. Cancellation between 12 and 6 hours before the reservation time, 50% of the reservation amount is due. Cancellation less than 6 hours before the reservation time, 100% of the reservation amount is due. Cancellation following a 20-minute wait at the pick-up location, 100% of the reservation amount and 10 euros waiting fee are due. Cancellation must be made either by email or by SMS, to the site contact details which are transmitted during the reservation and which are available on our website.
PASSENGER-CUSTOMER RESPONSIBILITIES It is prohibited to smoke or transport animals (except prior arrangements), explosive, corrosive, dangerous, toxic or flammable substances inside the vehicles of our VTC drivers. The liability of the passenger-customer will be incurred in the event of non-compliance with these rules, and Chauffeurs-VTC will reserve the possibility of any appropriate recourse.
All delays in transport times due to unforeseeable traffic problems will not give rise to any right to compensation, whatever they may be. ayay-driver also reserves the right to subcontract all private transport services to drivers selected by it.

INSURANCE:

ayay-driver is committed to doing everything possible to support its passengers in the best safety conditions and as quickly as possible to their destination. Thus, all of our partner drivers have the guarantees of reputably solvent insurance companies, covering all the risks relating to their activity, in accordance with the legislation in force. These insurance contracts cover in terms of civil liability all direct material and immaterial damage and bodily injury occurring to the passenger, within a limit set according to the current insurance contract. And this with the exception of damage due to the customer's responsibility, from getting into the vehicle until getting out, these two actions remaining included.

SKILLS

These General Conditions of Use are governed by French law, and any disputes relating to their interpretation or execution will be submitted to the Commercial Court.
